2. Orders, Payment and Contract Formation

Your order identifies the service, its prepaid service period and the applicable price. You can review your order details before submitting the order. The order becomes binding when payment for that order is successfully completed.

Submitting an unpaid order or receiving an unpaid invoice does not by itself make a new order binding. The order confirmation records the services purchased and the relevant billing period.

Service-specific descriptions, activation requirements and any additional conditions disclosed during the order process form part of the order. Activation follows successful payment and any applicable technical or eligibility checks. Payment alone does not guarantee that a requested domain name is available.

Back to contents

3. Services Covered

These terms cover the services offered through FuturaHosters.com, including web hosting, voice servers, game servers, domain services, SSL certificates, email hosting and Swiss Backup, where available.

Including a service in these terms does not mean that it is currently available for purchase. The service description and options shown when ordering determine what is included in the service you purchase.

NordVPN

We resell NordVPN through MarketConnect. We handle your order, billing and commercial support; Nord operates the VPN service. Activation requires a separate Nord Account and compliance with the applicable Nord terms, including its service-specific conditions and eligibility requirements. The standard Nord terms provide for personal, non-commercial use. Features and supported devices are those included in the subscription purchased, not every feature advertised for other Nord products.

Our Swiss hosting and Swiss Backup commitments do not describe the location or operation of the NordVPN network. Our contractual responsibilities and the applicable CHF 500.00 liability limit also apply to our resale of NordVPN, subject to mandatory law; referring to Nord terms does not remove our own obligations.

4. Modification of these Terms of Use

FuturaHosters.com reserves the right to change the terms, conditions, and notices under which the FuturaHosters.com Web Site is offered, including but not limited to the charges associated with the use of the FuturaHosters.com Web Site.

5. Prepayment, Renewals and Unpaid Services

All services are prepaid. The service period is shown during purchase and in the order confirmation. Payment methods are PayPal and credit/debit card; customers in Switzerland may also pay by bank transfer.

Voice and game servers

Voice and game server subscriptions are paid monthly in advance. Renewal invoices are issued 14 days before the end of the current prepaid month and must be paid by the end of that period.

Web hosting and domain names

Web hosting and domain subscriptions are paid annually in advance. Renewal invoices are issued 60 days before the end of the current prepaid year and must be paid by the end of that period.

Other services

For Swiss Backup and other services, the prepaid term and payment deadline are those shown in the order and invoice. No different billing cycle is implied by a monthly equivalent price displayed on a marketing page.

Suspension and termination for non-payment

If payment is not received by the due date, only the unpaid service is suspended or deactivated. Other services on the same customer account continue to operate while their own subscriptions remain paid and active.

If the suspended service remains unpaid for 30 days after its suspension, that service is terminated and its associated data are permanently removed. This does not close the customer account or terminate other paid services.

Domain expiry, restoration and deletion also depend on the rules of the relevant registry and registrar. Those rules may provide different or shorter deadlines and additional restoration fees.

For NordVPN, the prepaid period, renewal price and payment deadline are those shown in your order and renewal invoice. Manage purchases and cancellation requests made through us in our customer portal. Deleting a Nord Account or uninstalling an application does not itself cancel the subscription with FuturaHosters.com.

6. Cancellations, Refunds and Data Deletion

You can allow a prepaid service to expire by not paying its renewal invoice. The non-payment process described above applies to that service only.

You can also submit a cancellation request through the customer portal and choose the requested deactivation time using the options available there. The data-retention period starts on the effective deactivation date you select, not on the date you submit the cancellation request.

No refund or credit is provided for the unused part of a prepaid service period when you voluntarily cancel early, request early deactivation or stop using the service. This rule does not exclude rights or remedies that cannot be excluded under applicable law.

For voluntary cancellation, service data remaining at deactivation are retained for 30 days from the effective deactivation date and are then permanently deleted. For non-payment, the corresponding 30-day period starts at suspension, as described above.

The retention period does not keep the deactivated service operational. It does not restore copies already deleted or expired under the customer's own backup policies. Customer-directed deletion and retention settings continue to determine which individual backup copies exist.

This service-data deletion rule does not override legal record-keeping or preservation obligations for invoices, contractual records or other information that must legally be retained.

A cancellation concerning one service does not cancel other services on the same account. Domain registrations and transfers remain subject to the domain-specific terms below.

NordVPN: 15-day refund exception

As an exception to the rule against refunds for early cancellation, you may request cancellation and a full refund of your initial NordVPN subscription payment by opening a support ticket within 15 calendar days of that payment. This exception applies to the initial purchase, not subsequent renewals. Cancellation following a refund ends the refunded subscription. Requests for purchases made through us must be addressed to FuturaHosters.com; offers for purchases made directly from Nord do not automatically apply to our sales. Mandatory rights remain unaffected.

Cancellation or expiry of a NordVPN subscription does not automatically delete the separate Nord Account. Our 30-day service-content deletion rule does not govern data held independently by Nord; its retention and deletion arrangements are described in its privacy notices. Our own order and customer records remain subject to our Privacy Policy.

There are by the way some kind of contents that are absolutely NOT PERMITTED on our Servers. • Violate any applicable laws or regulations.

10. Service Availability

Service interruptions may result from events outside our reasonable control. The Force Majeure section addresses such events. Ordinary operational responsibilities and the express protection and security commitments for Swiss Backup are not removed merely because an interruption or security incident occurs.

11. Customer Content and Personal Data

You retain ownership of your website content, uploaded files and backup data. You grant us only the rights needed to store, copy, transmit and otherwise process that content to provide the services you order and to follow your documented instructions, subject to applicable law.

Entrusting data to our hosting or backup services does not give us permission to publish that data, use it for our own advertising, or publish your name in connection with it.

You are responsible for having the rights and legal basis required to upload and instruct us to process the data. Where we process personal data on your behalf, processing must follow the applicable instructions and data-protection requirements, including confidentiality and security. Any additional data-processing terms agreed for the service also apply.

Our Privacy Policy explains the processing of personal data relating to the website, account and services.

12. Liability and CHF 500.00 Limit

The maximum amount of our liability in relation to any service is CHF 500.00, to the extent permitted by applicable mandatory law. The same limit applies to every type of service, including web hosting, voice servers, game servers, domain services, SSL certificates, email hosting and Swiss Backup.

This limitation does not exclude or limit liability where the law does not allow that liability to be excluded or limited, or remove mandatory rights and remedies.

The limitation applies together with our express service commitments, including the protection and security responsibilities stated for Swiss Backup. It does not replace those commitments with a general disclaimer of all responsibility.

13. Service Suspension and Termination

Non-payment affects only the unpaid service and follows the suspension, termination and deletion rules in these terms. Other paid and active services continue to operate.

Other restrictions or suspensions may be required by applicable law or arise from a breach of the Acceptable Usage Policy. They are handled under the relevant legal or contractual basis and do not create a separate unrestricted right to terminate any paid service for any reason.

The cancellation, data-retention and backup provisions remain applicable to the relevant service, subject to mandatory legal requirements.

16. Service Commitments and Warranties

We provide the service described in your order and remain responsible for the express commitments in these terms, including the protection and security responsibilities for data stored under Swiss Backup.

Except for expressly agreed service commitments and mandatory legal requirements, we do not promise uninterrupted or error-free operation, or performance levels that are not stated in the order. This paragraph does not cancel the express Swiss Backup data-protection and security commitment.

17. Disclosure to Authorities

We disclose customer or service data to authorities only where required or otherwise permitted by applicable law. We assess the identity and competence of the requesting authority, the legal basis for the request and its scope before disclosing information.

Disclosure is limited to the data needed for the lawful purpose and remains subject to applicable data-protection and cross-border disclosure requirements. An informal request alone is not treated as unrestricted permission to disclose all customer information.

Customer notification is handled according to the applicable legal requirements, including any restriction on notifying the customer. This clause does not waive the customer's mandatory data-protection rights.

Back to contents

18. Backups and Swiss Backup

Backups for hosting and other services

Unless backup storage is included in the ordered service or separately purchased, the customer is responsible for keeping a current copy of the content they need to retain.

Provider responsibilities

Swiss Backup is a paid backup service using Acronis Cyber Protect. We guarantee the protection and security of the backup data entrusted to us within the scope of the Swiss Backup service. The service-liability provisions below apply subject to mandatory law.

Customer configuration and monitoring

The customer has access to the complete backup configuration and manages the selection of data, backup schedules, policies, retention periods, deletion of copies and recovery settings.

The customer is responsible for monitoring whether backup jobs actually run and complete successfully, checking the available backup status and reporting failed or missing backups through the support portal.

Our responsibility for protecting and securing stored backup data is separate from the customer's responsibility for configuring and monitoring their backups. A customer-defined policy may expire or delete individual copies; those settings must match the customer's own recovery needs.

Self-service restoration

The customer starts and manages restoration directly through the backup platform. A restore can be initiated immediately and uses the full bandwidth available to the transfer. Completion time depends on the volume of data and the available network and source/destination performance; immediate initiation does not mean that all data are restored instantaneously.

Customer-defined retention policies apply while the service is active. The 30-day service-data deletion rules following non-payment or voluntary deactivation are described in the payment and cancellation sections. That period does not recreate backup copies already deleted or expired under the customer's own policies.

19. Changes To FuturaHosters.com's Network

Upgrades and other changes in FuturaHosters.com's network, including, but not limited to changes in its software, hardware, and service providers, may affect the display or operation of Customer's hosted content and/or applications. FuturaHosters.com may make commercially reasonable changes to its network. Our express service commitments and the liability provisions in these terms continue to apply to such changes.

Customer may change his, her or its notice address by a notice given in accordance with this Section.

21. Force Majeure

A party is not responsible for a delay or failure caused by an event outside its reasonable control to the extent that the event and its effects could not reasonably have been prevented or overcome in fulfilling its contractual obligations.

The affected party must take reasonable steps to reduce the impact and resume performance. This section does not remove ordinary operational duties, our express Swiss Backup protection and security responsibilities, or liability that cannot be excluded under mandatory law.

Back to contents

22. Governing Law and Jurisdiction

This agreement is governed by Swiss law, subject to mandatory rules that apply to the particular contract.

For business customers, the agreed place of jurisdiction is Mendrisio, Switzerland, to the extent permitted by law. For consumers, mandatory jurisdiction rights and mandatory consumer protections remain reserved, including any right to bring proceedings before the competent courts at the consumer's domicile.

Nothing in this clause requires a consumer to waive a jurisdiction or protection that cannot be waived in advance.

23. Contract Language

Italian is the official contractual language of these terms. English and other language versions are provided for convenience. In the event of a discrepancy between language versions, the Italian version prevails, subject to any mandatory rights concerning language, transparency or consumer protection.

24. Miscellaneous

Each party acknowledges and agrees that the other party retains exclusive ownership and rights in its trademarks, service marks, trade secrets, inventions, copyrights, and other intellectual property. Neither party may use the other party's name or trade mark without the other party's prior written consent. The parties intend for their relationship to be that of independent contractors and not a partnership, joint venture, or employer/employee. Neither party will represent itself to be agent of the other.

Each party acknowledges that it has no power or authority to bind the other on any agreement and that it will not represent to any person that it has such power or authority. Updates under the Modification of these Terms of Use section and the applicable AUP amendment provisions do not require an individually signed agreement. Other individually negotiated changes require written agreement between the parties. Mandatory legal restrictions on amendments remain applicable.

The terms on Customer's purchase order or other business forms are not binding on FuturaHosters.com unless they are expressly incorporated into a formal written agreement signed by both parties. A party's failure or delay in enforcing any provision of the Agreement will not be deemed a waiver of that party's rights with respect to that provision or any other provision of the Agreement.

A party's waiver of any of its right under the Agreement is not a waiver of any of its other rights with respect to a prior, contemporaneous or future occurrence, whether similar in nature or not. The captions in the Agreement are not part of the Agreement, but are for the convenience of the parties.

The following provisions will survive expiration or termination of the Agreement: Fees, indemnity obligations, provisions limiting liability and disclaiming warranties, provisions regarding ownership of intellectual property, these miscellaneous provisions, and other provisions that by their nature are intended to survive termination of the Agreement. There are no third party beneficiaries to the Agreement. Neither insurers nor the customers of resellers are third party beneficiaries to the Agreement.

Customer may not transfer the Agreement without FuturaHosters.com's prior written consent. FuturaHosters.com's approval for assignment is contingent on the assignee meeting FuturaHosters.com's credit approval criteria. FuturaHosters.com may assign the Agreement in whole or in part. This Agreement together with the Order and AUP constitutes the complete and exclusive agreement between the parties regarding its subject matter and supersedes and replace any prior understanding or communication, written or oral.

31. Domain Registration, Renewal and Transfers

Registration and renewal

Domain registration and renewal require advance payment of the fees stated when ordering. A request is subject to domain availability, successful processing and the eligibility requirements of the relevant registry and registrar. Payment alone does not guarantee that the requested domain can be registered.

Registration, renewal and completed transfer fees are non-refundable once the relevant operation has been completed. An operation that fails before completion is distinct from a successfully completed operation; its applicable fee treatment must be disclosed when ordering.

Domain holders must keep their registration and contact details accurate and maintain access to the account and email addresses used for domain management.

Expiry and restoration

The rules for expiry, renewal, suspension, restoration and deletion vary by top-level domain. The relevant registry and registrar rules apply, including any restoration fees and deadlines. A domain may become unavailable for recovery after those deadlines.

Transfers to and from FuturaHosters.com

Transfers require the domain holder's authorization and the information required by the relevant registrar, such as an authorization or transfer code. Any transfer lock or other restriction must have a basis in the applicable registry or registrar rules.

For generic top-level domains, the applicable ICANN Transfer Policy applies. Country-code domains, including .ch, follow their own registry rules. An approaching expiry date alone is not treated as a universal reason to reject a transfer.

We process transfer requests in accordance with those rules. There is no contractual provision automatically transferring ownership of a customer's domain to FuturaHosters.com solely because of a chargeback or payment dispute. Payment disputes and any permitted suspension or restriction are handled under the applicable contractual and domain-registration rules.

This includes but not limiting material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.

Examples of non-acceptable content or links: 'Pirated Warez', OGG, AVI, MPEG, ISO, 'Hacker programs or archives', 'Copyrighted Digital Movie Copies (DIVX)' and 'Unlicensed MP3'. The designation of any materials as such described above is left entirely to the discretion of FuturaHosters.com management.
