Version: 1.1

Effective date: 4 November 2026

Official contractual language: Italian

This Acceptable Usage Policy (AUP) forms part of the Terms of Service of FuturaHosters.com, operated by Mercury Labs SAGL, Via Industria 16, CH-6850 Mendrisio, Switzerland. Company Number: CHE-113.042.422; VAT Number: CHE-113.042.422 VAT.

Its purpose is to protect our customers, infrastructure and third parties against unlawful use and abuse. It must be read together with the Terms of Service and the description of the subscription purchased. Italian is the official contractual language, as provided in the Terms of Service.

1. Scope and Appropriate Use

This policy applies to the services offered by FuturaHosters.com, including web hosting, voice servers, game servers, domain services, SSL certificates, email hosting and Swiss Backup, where available. Listing a service does not mean it is currently offered for purchase.

General rules against unlawful content, abuse and interference apply to all services. Restrictions identified as shared hosting restrictions apply only to shared web hosting and do not prohibit features expressly included in another service you purchase.

Shared web hosting space must be used for your website and its associated files. It must not be used primarily as a general-purpose file archive or backup repository. Swiss Backup may be used for backups and data archiving within the resources included in the subscription purchased. This AUP imposes no additional Swiss Backup resource limits beyond that subscription.

This policy also applies to NordVPN subscriptions resold by FuturaHosters.com. Hosting-specific storage and server restrictions do not become VPN resource limits merely because NordVPN is purchased through us. The subscription and applicable Nord conditions determine permitted VPN use.

2. Shared Hosting Restrictions

The following restrictions apply to shared web hosting. Unless expressly included in the purchased service, you must not use shared hosting to:

  • Run distributed computing, mining or other workloads unrelated to hosting your website.
  • Run persistent chat servers or interactive real-time server applications.
  • Run stand-alone, unattended server processes or daemons.
  • Run peer-to-peer or file-sharing network clients or servers.
  • Operate software distribution mirrors or download mirror platforms.
  • Operate internet speed test platforms or hosts.

These restrictions do not prohibit the normal operation of voice servers, game servers or other functionality expressly included in a separate service purchased for that purpose.

3. Resources and Bandwidth

Storage, bandwidth and other resources are those specified in the subscription or service description applicable to your order. Use must remain within those resources and must not compromise the security, stability or availability of the platform or other customers' services.

Where a plan advertises unlimited bandwidth, this does not mean unlimited storage, CPU, RAM or connection speed. Actual transfer performance depends on the connection and technical resources available to the service.

4. Fair Use and Infrastructure Protection

You must not use a service in a way that disrupts the shared infrastructure or materially interferes with other customers. This applies even where a particular resource is described as unlimited.

If use causes such interference, we may contact you through the ticket system to explain the problem and request corrective action. Urgent protective measures may be taken where necessary under the enforcement provisions below. This policy does not introduce additional numerical resource limits for Swiss Backup: its allocated resources are determined by the subscription purchased.

5. Prohibited Content

You must not publish, distribute or transmit through our services:

  • Child sexual abuse material or other sexual exploitation content.
  • Pornographic or adult sexual content prohibited by our Terms of Service.
  • Content that incites or threatens violence, harasses others or constitutes unlawful hate speech.
  • Fraudulent or deceptive content, including phishing, pyramid schemes and high-yield investment scams.
  • Content that unlawfully infringes privacy, confidentiality, copyright, trademarks or other rights.
  • Content facilitating illegal drug sales, illegal gambling, unlawful arms trafficking or other unlawful activities.
  • Malware, stolen credentials, pirated software or instructions intended to facilitate unauthorized access or circumvention of technical protections.

These rules cover website content, email, forum posts, files and other transmissions using our services. Warez distribution and services intended to conceal or facilitate abuse, including open proxies operated for that purpose, are prohibited. A proxy, escrow service or other technology is not prohibited solely because of its name; its use must comply with this policy and the purchased service.

6. Account and Data Security

You must protect your accounts, credentials and systems; use strong, unique passwords; and enable multi-factor authentication where available. Keep applications, plugins and other software under your control updated and appropriately secured.

Notify us promptly through the ticket system if you discover a compromise or misuse affecting your service. Cooperate with reasonable steps to contain the incident and prevent recurrence.

For Swiss Backup, you control backup configuration, policies, retention, deletion and restoration. You are responsible for monitoring backup execution and checking that your configuration meets your needs. Our responsibilities for the protection and security of stored data remain as stated in the Terms of Service.

7. Bulk Email Prohibition

Bulk sending from our servers is prohibited, including bulk commercial email, newsletters, mailing lists and email reflector services, even where recipients have consented. Do not use our servers as a bulk delivery platform.

This restriction does not prohibit ordinary individual correspondence or individual service-related messages that otherwise comply with this policy. Any separate service explicitly intended for bulk delivery would require its own express service terms.

8. Spam and Unsolicited Email

You must not send spam or unsolicited promotional email using our services. You must not use purchased, harvested or otherwise unauthorized recipient lists, forge sender identities or headers, or use compromised accounts to send messages.

The prohibition on bulk sending above applies independently of whether recipients have consented. You must also comply with applicable law and the rules of networks you access through our services.

You may host, copy or distribute protected material only where you hold the necessary rights or authorization, or the use is otherwise permitted by applicable law.

We may investigate sufficiently specific reports of infringement and take measures under this policy and applicable law. Serious or repeated violations may lead to termination of the affected service.

10. Customer Information and Communications

Keep the contact information associated with your customer account accurate and current. For domain names, maintain the registration details required by the applicable registry and registrar.

Communications about abuse, security incidents and corrective action are normally handled through the customer portal ticket system. You must monitor these communications and respond within any reasonable deadline specified.

11. Enforcement and Relationship with the Terms

For a violation that can be corrected without an immediate risk, we normally notify you through the ticket system, explain the issue and specify a reasonable deadline for corrective action.

We may act immediately where necessary to contain an attack, compromise, unlawful activity or other urgent threat to systems, data or third parties. Measures may include blocking abusive traffic, restricting access or suspending the affected service. Serious or repeated violations, or failure to take the requested corrective action, may lead to termination.

Measures normally concern the service involved. They may extend to other services only where necessary to contain a connected risk. The scope and duration of protective measures should reflect the issue being addressed.

This AUP does not establish a separate refund entitlement or a discretionary refund scheme. Billing, termination, data handling and any applicable refund consequences are governed by the Terms of Service and mandatory law. The Terms of Service prevail in the event of a conflict.

We do not undertake routine monitoring of all customer content under this AUP. This does not exclude our contractual security commitments or obligations imposed by applicable law.

12. Network and Internet Abuse

You must not engage in illegal, abusive or unauthorized activity, including:

  • Accessing systems, accounts or data without authorization, or scanning and testing systems without the necessary permission.
  • Intercepting network traffic or monitoring systems without authorization.
  • Denial-of-service attacks, flooding, mail bombing or deliberate overloading of systems.
  • Phishing, credential theft, exploitation of security vulnerabilities or distribution of malware.
  • Forging network packet headers or message headers to deceive recipients or conceal abuse.
  • Using our services to conduct attacks or other abusive activity that threatens the availability or security of our network or third parties.
  • Materially interfering with other customers' use of the infrastructure.

Security testing must be authorized by the relevant system owner and must not disrupt our infrastructure or third parties. Permission to test your own application does not authorize testing shared infrastructure or another customer's service.

13. Third-Party Networks and Reporting

When using third-party networks, forums, chat services or other online communities, comply with their applicable rules and the law. Do not use our services to post spam, conduct harassment or evade restrictions imposed for abusive behavior.

For questions or to report suspected abuse affecting our services, open a support ticket. Provide enough information to identify the affected service and the activity concerned, without unnecessarily disclosing sensitive data.

NordVPN use

A VPN does not authorize unlawful activity, spam, attacks, fraud or infringement of third-party rights. Follow the Nord terms and service-specific restrictions. Nord may take protective measures under its conditions; we may separately act under these Terms and AUP. This does not imply routine inspection of VPN browsing by FuturaHosters.com or remove either party's applicable responsibilities.
